TSR Annual Food Drive Jo Koy Tickets Giveaway – Official Rules & Private Policy

Giveaway Period:

Tom Shinsato Realty, Inc. “Annual Food Drive Jo Koy Tickets” Giveaway (“Giveaway”) begins at 8:00 AM Hawaii Standard Time (HST) on September 16, 2024 and ends at 5:00 PM on November 8, 2024 (“Entry Period”).

Eligibility: This giveaway is only open to legal residents of the state of Hawaii residing in Oahu who are eighteen (18) years of age or older as of September 16, 2024. The giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

Agreement to Rules: By participating, the Entrant (“you” or “your”) agree to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements herein. In addition, You agree to accept the decisions of TSR as final and binding as it relates to this Giveaway.

How to Enter: The Giveaway must be entered by donating goods (non-perishable items and/or unexpired food) to our office. The entry must fulfill all Giveaway requirements, as specified herein, to be eligible to win the prize. Entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of TSR. One item equals one entry. Multiple items will equal multiple entries.

Prize: The Winner of the Giveaway will receive two (2) tickets to Jo Koy’s show that will be held on Friday November 29, 2024, at the Blaisdell Arena (the “Prize”). No cash or other Prize substitutions shall be permitted except at the sole discretion of TSR.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of TSR. Winner will be notified via phone call, text message and/or email on November 12, 2024. TSR shall have no liability for Winner’s failure to receive notices due to phone issues, Winner’s provision of incorrect or otherwise non-functioning contact information, or any technical limitations or malfunctions whatever the cause. If winner cannot be contacted, is ineligible, fails to claim the Prize within seven (7) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the Prize may be forfeited and an alternate Winner selected in the sole discretion of TSR. Receipt by Winner of the Prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED IN TSR’S SOLE DISCRETION.

Rights Granted by You: By entering the Giveaway, You understand and agree that TSR, anyone acting on behalf of TSR, and TSR’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

Terms & Conditions: TSR reserves the right, in its sole discretion, to cancel, terminate, modify, suspend the Giveaway (the “action”) if circumstances beyond its control affect the administration or fairness of the Giveaway. TSR may select a Winner from all eligible entries received before or after such action. TSR reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process or violates the Terms and Conditions.  While multiple donations are allowed, entries must comply with the rules, and any excessive or fraudulent attempts to gain an unfair advantage may result in disqualification. TSR reserves the right to take legal action if necessary to address any attempt to disrupt the Giveaway to the fullest extent permitted by law.

Limitation of Liability: By entering, You agree to release and hold harmless TSR, its representatives, and agents from any liability, illness, death, loss, litigation, claims, or damages that may occur, directly or indirectly, whether caused by negligence or not, arising from:

(i) Your participation in the Giveaway and/or your acceptance, possession, use, or misuse of any prize or any portion thereof;

(ii) Technical failures of any kind, including but not limited to, the malfunction of any mobile device, computer, cable, network, hardware, or software, or other mechanical equipment;

(iii) The unavailability or inaccessibility of any human error in the administration of the Promotion or the processing of entries.

Upon receipt of the prize, title and risk of loss pass to the winner. The sponsor shall bear no responsibility or liability for any loss, theft, damage, or misplacement of the prize occurring after it has been received. In the event that the prize is lost, stolen, damaged, or otherwise rendered unserviceable after receipt, the sponsor shall not be obligated to replace the prize or provide any form of compensation or reimbursement. The winner assumes full responsibility for the safeguarding and maintenance of the prize from the moment it is received and acknowledges that the sponsor has no further obligation regarding the prize thereafter.

Disputes: THIS Giveaway IS GOVERNED BY THE LAWS OF the state of Hawaii, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, Entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the state of Hawaii having jurisdiction.
